Terms of Use

These terms have not yet been reviewed by a lawyer.

1. Who we are

DB8 ("the app", "we") is operated by Cezar Drumea, an individual based in Romania (a full postal address is available on request via support@gifchat.app). Contact: support@gifchat.app. Website: https://db8tv.com.

By creating an account or using DB8 you accept these Terms. If you do not accept them, do not use the app. The Privacy Policy, Community Guidelines, Creator Payout Terms and DSA Notice and Appeals page are part of these Terms.

2. What DB8 is

3. 18+ only

You must be at least 18 years old. You must give your real date of birth and pass an identity (ID) check with our verification provider. If we find or suspect you are under 18, or that you gave false data, we will close your account. Do not let anyone else use your account.

4. Your account

Give true information. Keep your login secure. You are responsible for what happens under your account. One person, one account. If we ban an account, do not make a new one to get around the ban.

5. Recording, AI judging and your content

By joining a battle or debate you agree to the consent texts shown in the app before that activity (see our consent screens). In short:

You keep ownership of your content. You give us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, display and, for debates, record, transcribe and show your content as needed to run, secure and improve DB8 and to show verdicts and results. The licence ends when your content is deleted, except for copies we must keep by law or for safety (see the Privacy Policy).

You must have the right to share what you stream. Do not record, screenshot or re-share other users' streams or faces without their permission.

6. AI decisions: advisory, not guaranteed

7. Conduct

You must follow the Community Guidelines. In particular, you must not:

8. Moderation

We scan live video automatically (our provider is Hive), and we act on user reports. We may remove content, end a stream, mute, suspend or ban an account, or withhold payouts linked to a breach. You can report and block other users inside the app. We publish how we handle illegal-content notices in the DSA Notice and Appeals page.

9. Bans, suspension and appeals

We may suspend or ban you if you break these Terms or the law, or to protect people. Where required by the EU Digital Services Act, we tell you what we did and why (a "statement of reasons") and you can appeal; see the DSA Notice and Appeals page. We may skip notice in urgent safety cases or where the law forbids it.

10. Coins and gifts

11. Our rights

DB8, its design, code, brand and the AI judging system belong to us or our licensors. We give you a personal, limited, non-transferable licence to use the app. Third-party services (Apple, Stripe, etc.) have their own terms.

12. Availability and changes

We may change, pause or stop features (including servers, gifts or the AI judge) at any time. We will tell you about important changes to these Terms (normally at least 30 days) before they apply. If you keep using the app after the change, you accept it; if not, you can delete your account.

13. Termination by you

You can delete your account in the app settings or by writing to support@gifchat.app. Unspent coins are lost on deletion, except where the law says otherwise. Unpaid creator balances are handled under the Payout Terms.

14. Liability

The app is provided "as is". Nothing here limits liability that cannot be limited by law (for example for death, personal injury, fraud or intent, or your mandatory consumer rights). Subject to that, we are not liable for: other users' content or behaviour, AI errors, losses from outages, or indirect losses.

You are responsible for what you do in video chats with strangers. Do not share personal data, meet strangers, or send money to people you meet on the app.

15. Governing law and disputes

These Terms are governed by Romanian law. If you are a consumer in the EU you keep the mandatory consumer protection of your country of residence and may bring a claim in your local courts. Subject to that, disputes are for the competent Romanian courts. EU consumers can also use the EU Online Dispute Resolution platform and out-of-court dispute bodies under DSA Art. 21 where available.
